Plaintiff Must Produce Photographs from Personal Facebook Page

Last week, in Nucci v. Target Corp, a Florida appellate court ordered a plaintiff to produce photographs from her personal Facebook page.  In this personal injury action, in which the plaintiff claims to have fallen at defendant’s store, the court determined that “[t]he photographs sought were reasonably calculated to lead to the discovery of admissible evidence and Nucci’s privacy interest in them was minimal, if any.”  The court went on to say that it was denying plaintiff’s petition to quash the order compelling discovery of the photos “[b]ecause the discovery order did not amount to a departure from the essential requirements of law.
