Counsel 3 – Social Media
Marketing/Advertising Legal Support
• Work closely and collaboratively with Enterprise Marketing, Regional Bank Marketing and Corporate Communications teams to provide practical and strategic advice and solutions on internal and external marketing and advertising programs, campaigns and promotions
•Clear a high volume of marketing and advertising materials for TV and radio commercials, digital, direct mail, social media, email, sweepstakes and contests, sales and training materials, in-store ads and market research
•Day-to-day counseling on deceptive practices, copyright, trademark, right of publicity/privacy rights and other federal and state consumer protection laws
•Oversee the negotiations and drafting of a wide variety of contracts including complex sponsorships, production agreements, talent agreements, charitable/cause marketing, joint marketing, social media, digital marketing, merchandising, agency and intellectual property agreements
•Comprehensive trademark guidance including advising on brand strategy, searches, clearance, prosecution and management of infringement matters
•Advise on structure and assist in drafting official rules, agreements and advertising materials for nationwide sweepstakes, contests and cause marketing campaigns
•Knowledge of the FFIEC Guidance on Social Media, FTC’s Guides for Online Advertising Disclosures and Endorsements and Testimonials and UDAAP and ability to advise on each
Social Media Legal Support
•Provide guidance on strategies and solutions for novel legal issues in the digital marketing and social media space
•Assist in development of and advise on social media matters including corporate policy, platforms and contracts, brand protection strategies and company-wide social media projects
•Familiarity with or willingness to learn about current and upcoming social media platforms, review sites and other technology and their capabilities and limitations
•Assess brand, marketing and intellectual property risks as well as other legal risks of participating in social media including user-generated content and use of incentivized influencers
Other Legal Support
•Provide marketing, advertising, trademark, copyright and related IP advice on traditional vehicles
5+ years experience as a practicing attorney. Juris Doctorate. State Bar membership is required.
Demonstrated ability to provide research, counsel and guidance on complex legal questions or inquiries. Ability to analyze legal issues in substantive law in area of practice, provide effective advice to clients on routine legal matters. Strong verbal and written communications skills; interpersonal skills; excellent organizational skills and attention to detail; flexibility and adaptability to changing priorities and deadlines.
Additional Minimum Quals
5+ years’ experience in providing legal advice and counsel in the area of marketing/advertising, social media, trademark practice before the PTO, naming searches and opinions. Working knowledge of copyright, Rights of privacy/publicity, law of deceptive practices.
Having provided legal advice to a Fortune 500 Company on social media, email, sweepstakes and contests, sales and training materials and market research. Guidance on legal issues related to digital marketing and social media. Familiarity with current and developing social media platform and related technology.
